Garifuna live in Central America, primarily Honduras, and the United States. Identified as Black by others and by themselves, they also claim indigenous status and rights in Latin America. Examining this set of paradoxes, Mark Anderson shows how, on the one hand, Garifuna embrace... discourses of tradition, roots, and a paradigm of ethnic political struggle. On the other hand, Garifuna often affirm blackness through assertions of African roots and affiliations with Blacks elsewhere, drawing particularly on popular images of U.S. blackness embodied by hip-hop music and culture. Black and Indigenous explores the politics of race and culture among Garifuna in Honduras as a window into the active relations among multiculturalism, consumption, and neoliberalism in the Americas. Based on ethnographic work, Anderson questions perspectives that view indigeneity and blackness, nativist attachments and diasporic affiliations, as mutually exclusive paradigms of representation, being, and belonging. As Anderson reveals, within contemporary struggles of race, ethnicity, and culture, indigeneity serves as a normative model for collective rights, while blackness confers a status of subaltern cosmopolitanism. Indigeneity and blackness, he concludes, operate as unstable, often ambivalent, and sometimes overlapping modes through which people both represent themselves and negotiate oppression. Read more

An exemption clause is an agreement in a contract that stipulates that a party is limited or excluded from liability. A term is unfair if: - it's contrary to good faith - it causes a significant imbalance in the rights and obligations of the parties to the detriment of the consum...er. Exemption clauses and unfair terms can be used unfairly and, sometimes, disadvantage a party and their use is regulated. The two main pieces of legislation regulating their use are: 1. The Unfair Terms Act 1977 which now only applies to liability arising in the course of a business and in relation to liability arising towards other businesses; and 2. The Consumer Rights Act 2015 consolidates the provisions that previously applied to consumers under the Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations 1999. Macdonald's Exemption Clauses and Unfair Terms is an expert analysis covering both the incorporation and construction of the key clauses and the relevant legislation. Fully revised and updated, the new third edition will include coverage of: - the changes brought about by the Consumer Rights Act 2015 with a comparison of the Unfair Terms in Consumer Contracts Regulations 1999. - analysis and interpretation of case law which has considered the effect and interpretation of unfair terms since the 2nd edition such as: The Office of Fair Trading v Foxtons Ltd [2009] EWHC 1681 (Ch); The Office of Fair Trading v Ashbourne Management Services Ltd and Others [2011] EWHC 1237 (Ch); Case C-243/08 Pannon GSM Zrt v Erzsebet Sustikne Gyo?fi [2009] ECR I-04713; Case C-168/05, Elisa Maria Mostaza Claro v Centro Movil Milenium SL [2006] ECR I-10421 and the CMA analysis of these cases). - analysis and interpretation of the significant amount of case law which has dealt with exemptions since the 2nd edition - analysis and interpretatipon of how the courts now interpret contract clauses after the decisions of the Supreme Court in Rainy Sky S. A lot of people when drafting an agreement will concentrate on the core commercial terms, rather than the boilerplate clauses. Some see the word boilerplate as referring to unimportant contract terms. This is very dangerous as a failure to consider all the provisions of a commerc...ial agreement can have serious consequences. Often these consequences will come when it is too late to do anything about the contract terms, ie after the agreement is signed. A boilerplate clause sometimes deals with important operational issues such as the law of the contract or how notices may be sent. On other occasions, the clause deals with commercial issues that may not seem important, until a problem arises. For example, a force majeure clause only becomes significant if a party cannot perform its obligation due to circumstances beyond their control with such circumstances arising rarely, but when they do the force majeure clause comes into its own. A-Z Guide to Boilerplate and Commercial Clauses guides the user through each clause, explaining its purpose, considering its relevance in an agreement, discussing drafting issues and providing illustrative examples. The legal commentary and practical guidance helps the user to better understand the legal framework underpinning a boilerplate clause and how the courts are likely to view boilerplate and commercial clauses in the event of a dispute. For ease of reference the clauses are arranged in alphabetical order ranging from Acknowledgements to Warranties and are laid out in a modern, clear and accessible format. A set of typical boilerplate terms as they might be found in a commercial contract is included as an appendix. Since the third edition, major developments in case law and legislation have resulted in the revision of existing clauses and the development of new standard clauses. The clauses are contained on an accompanying CD-ROM. Read more
